By the present writ petition, the petitioner is seeking a direction towards the has prayed for following relief:-

“10.1 That, this Hon'ble Court may kindly be pleased to direct the respondent no.3 to pay the salary or allowances of the regular employee of the said post to the petitioner after completing of probation period with

effect from 5.3.2021 within stipulated period.

10.2 That, this Hon'ble Court may kindly be pleased to direct the respondent no.3 to release the salary of the month of May 2019 and March 2021 to the petitioner within stipulated period.

10.3 That, this Hon'ble Court may kindly be pleased to direct the respondent no.3 to consider and decided the representation filed by the petitioner annexure p/2 as early as possible.

10.4 Any other relief or reliefs may also be granted to the petitioner which this Hon'ble court deems fit and proper in the facts and circumstances of the case.;”

Learned counsel for the petitioner submits that the petitioner

was appointed as a Steno Typist on 06.03.2019 on probation for a period of two years and was posted at the Tahsil Office, Ramanujganj, District Balrampur-Ramanujganj (C.G.). On completion of the probation period, the services of the petitioner were regularized by respondent No. 2 vide order dated 28.07.2023 with effect from 05.03.2021, and annual increment was also sanctioned in his favour. However, despite completion of probation and issuance of the regularization order, respondent No. 3 has failed to extend the benefits of regular service, including the admissible salary and allowances, without assigning any reason. Learned counsel further submits that the petitioner has submitted representations requesting grant of the benefits of regular service in terms of the regularization order dated 28.07.2023

and also seeking release of the salary for the months of May 2019 and March 2021; however, no action has been taken by respondent No. 3 till date.

Learned counsel for the State, on instructions, submits that the claim of the petitioner regarding the regular pay scale and arrears will be considered and the same will be released within a period of one month from today.

I have heard learned counsel for the parties and also perused the documents annexed along with this writ petition.

Considering the submissions advanced by learned counsel for the parties and the facts and circumstances of the case, it is directed that the arrears payable to the petitioner shall be released within a period of one month. Further, the payment of salary to the petitioner in the regular pay scale will be initiated and completed within a period of 45 days from the date of receipt of a copy of this order. SD/-
