The petitioner has filed this petition seeking the following reliefs:

“10.1 That, this Hon'ble Court may kindly be pleased to direct respondent authorities give benefit of the Scheme and appoint petitioner as Assistant teacher/ Shikshakarmi Grade III as the benefit of scheme is granted to similarly placed persons i.e. respondent no. 8 to 11.

10.2 That, this Hon'ble Court may kindly be pleased to direct respondents to consider the candidature of petitioner and to

appoint him in the post of Assistant Teacher/ Shikshakarmi Grade III.

10.3 That, this Hon'ble Court may kindly be pleased to direct the respondents to give all consequential benefits to the petitioner from year 2006.

10.4 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the costs of the petition may be given.”

Learned counsel appearing for the petitioner would submit that the petitioner joined service on the post of Guruji (Teacher) under Shiksha Guarantee Mission on 1.1.2000 at Primary School, Mallapara, Village Gangaloor, District Beejapur. She would submit that the other schools which were being run under Rajiv Gandhi Primary Education Scheme were upgraded to Government Primary Schools and the Primary School, Mallapara was also upgraded. However, the petitioner was not granted promotion to the post of Shiksha Karmi Grade-III. She would submit that the petitioner has made repeated representations before the respondent authorities but till date, no action has been taken.

On the other hand, learned counsel appearing for the respondents would submit that in the year 2021, the age of the petitioner was 44 years and is now approximately 49 years old. It is also contended that the claim of the petitioner is hit by delay and laches.
