1) By way of this petition, petitioners have sought following reliefs:-

10.1 That, this Hon'ble Court may kindly be pleased to issue appropriate writ/ order whereby set aside/quash the impugned order dated 30-062021 (Annexure P-1) to the extent of respondent No. 6 (Sl.No. 1).

10.2 That, this Hon'ble Court may kindly be pleased to issue appropriate writ/direction to respondents authority to fill-up the post of Additional Commandant General (ACG) from the member of Department of Home Guards by way of promotion as per Home Guards (gazetted) Service Recruitment Rules, 1991.

10.3 That, this Hon'ble Court may kindly be pleased to pass any appropriate orders/ directions in favour of the petitioners looking to the facts and circumstances of the case

2) Learned counsel for the petitioner submits that respondent No. 6

has already retired from services, therefore petitioners may be permitted to make a detailed representation regarding filling up the post of Additional Commandant General (ACG) from the

member of Department of Home Guards by way of promotion as per Home Guards (Gazetted) Service Recruitment Rules, 1991 before respondent No. 1, who in turn may be directed to decide such representation at the earliest.

3) On the other hand, learned State counsel would oppose.

5) Taking into consideration the limited prayer made by Mr. Naik, this petition is hereby being disposed reserving liberty in favor of petitioners to make a detailed representation at the earliest before respondent No. 1, who in turn is directed to decide such representation strictly in accordance with the law, preferably within a period of 180 days from the date of receipt of copy of such representation.

6) With the aforesaid direction, this petition stands disposed of .
