“10.1 That this Hon’ble Court may kindly be pleased to direct the respondent to pay the salary of the petitioner for the period from the date of his suspension which is July 1997 till date of his superannuation which is 12.01.2010 with all applicable increments.

10.2 And the respondent may be further directed to pay the pension, gratuity, leave encashment and other admissible dues along with interest at the rate of 18% per annum, for the entire service period of the petitioner from the year 1974.

Learned counsel for petitioner submits that petitioner was initially appointed as Naib Tehsildar and he worked on the said post from the year 1974 till the year 1981. Thereafter, he was appointed as Deputy Collector vide appointment order dated 11.06.1981 and then he was deputed as Chief Executive Officer in Raipur Development Authority from 1995 to 1997. While working on the post of Chief Executive Officer he was implicated in a criminal case. Learned trial court has passed an order of conviction against petitioner under Section 13(1)(d) and Section 13(2) of the Prevention of Corruption Act, 1988 and pursuant to the order of conviction of petitioner, respondentsauthorities have terminated the service of petitioner vide order dated 13.10.2000. He contended that against the order of conviction, petitioner preferred an appeal before the High Court bearing CRA No. 1965/2000, whereby petitioner was acquitted from the charges vide judgment dated 01.09.2025. Petitioner thereafter had submitted a representation before Respondent on 12.09.2025 and thereafter on 30.03.2026, which are pending consideration.

Learned counsel for respondent submits that the representation of petitioner if pending consideration, it will be considered in accordance with law.

On due consideration of the facts and circumstances of the case, submission made by learned counsel for respective parties, further considering that petitioner has already submitted representation before Respondent, which is stated to be pending consideration, this writ petition at this stage is dispose off, permitting the petitioner to submit fresh comprehensive representation before Respondent along with all

supporting documents and if such a representation is submitted, the concerned authority shall consider and take decision on the representation to be submitted by petitioner, in accordance with law, expeditiously, preferably within a further period of 03 months from the date of receipt of representation.

With the aforesaid observation and direction, this writ petition is disposed of.
