Petitioners have filed this writ petition seeking following reliefs:-

“10.1. Issue an appropriate writ, order or direction, preferably in the nature of mandamus, declaring the action/inaction of the respondents in not considering and deciding the cases of the petitioners for regularisation, absorption continuation, or other appropriate service protection, despite long and continued utilization of their services, as arbitrary, discriminatory, unreasonable, and violative of Articles 14, 16 and 21 of the Constitution of India;

10.2. Issue an appropriate writ, order or direction commanding the respondents to regularize the services of the petitioners on the respective posts on which they

were engaged and are presently working under respondent No. 5, with all consequential benefits, within such time as this Hon'ble Court may deem fit and proper;

10.3. In the alternative, issue an appropriate writ, order or direction commanding the respondents to inspect and verify the muster rolls, service records, experience certificates, payment records, Treasury / D.K.S.-linked records, and all other relevant institutional records pertaining to the petitioners, and upon such verification, if the petitioners are found similarly situated to other dailywage/ temporary employees whose services have already been regularized, to regularize their services from the same date on which such similarly situated persons were regularized, with all consequential benefits:

10.4. Issue an appropriate writ, order or direction commanding the respondents to complete the entire exercise referred to hereinabove by passing a reasoned and speaking order, petitioner-wise, within a fixed time-frame as may be prescribed by this Hon'ble Court;

10.5. Pending completion of the aforesaid exercise, direct the respondents not to disengage, replace, remove, terminate, or otherwise disturb the working status of the petitioners, and not to fill up the posts presently being manned by the petitioners in a manner prejudicial to their claim;

10.6. Grant all consequential benefits, including continuity of service and such other service benefits as may found due in law, to the petitioners found entitled to regularisation /service protection pursuant to the orders of this Hon'ble Court;

10.7. Pass such other or further orders as this Hon'ble Court may deem just, fit, and

proper in the facts and circumstances of the case, including costs of this petition.”

Learned counsel for the petitioner submit that petitioners are daily wage employees working under respondent No.5 and were appointed on the post of Staff Nurse, Data Entry Operator, Assistant Grade-III, Librarian and Carpenter in the establishment of Dau Kalyan Singh Post Graduate Institute and Research Centre, Raipur since 2018 and have been continuing to work on the said post from the date of initial appointment, however, they have not been regularized. Therefore, direction be issued to respondent No. 5 to consider and take decision on the claim of petitioners for regularization of their service within specified time frame. He places reliance upon the judgment passed by Division Bench of this Court in case of Gopi Sao and Ors. Vs. State of Chhattisgarh & Ors in a writ appeal bearing WA No. 14 of 2017 dated 07.012.2018.

Learned counsel for respondents submits that as petitioners are not pressing this writ petition on merits and is only seeking direction to consider and take decision on the claim of petitioners for regularization of their service, they are having no objection.

I have heard learned counsel for the respective parties and perused the documents available on record.

Claim as raised by the petitioners in this writ petition is that they are continuously working as daily wage employees since 2018, however, till date he has not been regularized.

On due consideration of submission of counsel for the parties, the writ petition at this stage is disposed permitting the petitioners to submit fresh comprehensive representation before the respondent No. 5 and in the event, such representation(s) is/are submitted, concerned authority shall consider and take decision on their representations keeping in mind the period of service which the petitioner has completed as also the decision of Hon’ble Supreme Court on the issue of regularization of daily wage/temporary employee, expeditiously, in accordance with law expeditiously, preferably within a further period of 04 months from the date of receipt of representation.

Accordingly, this petition is disposed of with aforesaid observation and direction.
