In this petition, the petitioner has challenged impugned order dated 28.04.2020 (Annexure-P/01) by which he has been sent on deputation to the Chhattisgarh Road Development Corporation that too without obtaining his consent.

Learned counsel for the petitioner submits that the impugned order is bad, illegal, arbitrary and without authority of law. Hence, the same is liable to be set aside.

On the other hand, learned counsel for the respondent supported the impugned order and prays for dismissal of this petition.

I have heard learned counsel for the parties, considered their rival submissions made herein above and went through the record with utmost circumspection.

In the present case, a careful perusal of the record would show that since this Court passed interim order dated 02.06.2020 and stayed the effect and operation of impugned order 28.04.2020 (Annexure-P/01), which is still operating after lapse of more than 05 years, therefore, the impugned order 28.04.2020 (Annexure-P/01) is hereby quashed. However, the respondents are at liberty to pass fresh order against the petitioner, if there exists any administrative exigency.

With aforesaid observation, the writ petition stands finally disposed of. No cost.
