Petitioner has filed this petition seeking following relief (s) :-

“10.1 This Hon'ble Court may kindly be pleased to issue appropriate writ and direct the respondent authorities to consider and decide the petitioner's representation dated 13.01.2023 (Annexure P/4) within a time-bound period, by passing a reasoned and speaking order, in the interest of justice.

10.2 This Hon'ble Court may kindly be pleased to issue appropriate writ and direct the respondent authorities to the respondents to grant all consequential service benefits, including promotion, seniority, pay fixation, and all other admissible benefits, arising out of the correction of her cadre from E-Cadre to T-Cadre (L.B.), with retrospective effect, in the interest of justice.

10.3 Any other relief which the Hon'ble Court deems fit and proper under the facts and circumstances may also be provided to the petitioner.”

Learned counsel for petitioner submits that petitioner was initially working as Shiksha Karmi in Tribal Department. According to policy formulated by the State Government, services of teachers working with the Tribal Panchayat Department has been absorbed and those teachers have been placed in T-Cadre. At the time of absorption due to some typographical error, name of petitioner is shown in the gradation list of E-Cadre teachers. After getting knowledge, petitioner submitted representation before the respondent No.5 for correction of

gradation list so far as it relates to petitioner to be placed in gradation list of T-Cadre instead of E- Cadre, however, till date such correction has not been made.

Learned counsel for respondent No.5 would submit that after getting knowledge and receipt of representation from petitioner, respondent No.5 wrote letter to respondent No.3/District Education Officer for taking necessary steps for correction of cadre of petitioner from E Cadre to T- Cadre as services of petitioner has been adsorbed by the School Education Department and petitioner is under the control of respondent No.3.

Learned State counsel submits that she may be granted time to seek instructions in the matter.

I have heard learned counsel for parties.

Grievance of petitioner is only to correct the cadre mentioned against the name of petitioner as E Cadre to T Cadre and by that and as stated by counsel for petitioner, name of petitioner would be mentioned in the gradation list of teacher of T- Cadre.

According to document Annexure P-5 dated 13.02.2023, it is appearing that respondent No.5, Chief Executive Officer, Zila Panchayat has already written letter to the respondent No.3/District Education Officer under whom, petitioner is working for making necessary correction. As stated by learned counsel for petitioner till date no such correction has been made in the service record.

In the aforementioned facts of the case, instead of keeping this petition pending seeking reply from the respondents, I find it appropriate to dispose of this writ petition at this stage, directing respondent No.3 to

take appropriate steps for making necessary correction as mentioned in the letter dated 13.02.2023 (Annexure P-5) written by respondent No.5 in accordance with law expeditiously preferably within further period of three months from the date of receipt of this order. It is ordered accordingly.

Accordingly, this petition is disposed of with the aforesaid observations and directions.
