Chhattisgarh High Court, Bilaspur (Parth Prateem Sahu, J.), common order dated 05/01/2026 (NAFR) allowing WPS Nos. 11772, 12394, 12400, 12397 and 11765 of 2025. Recruitment to the post of Swachhkarta/Paricharak Sah Chowkidar was initiated by advertisement dated 29.02.2012 issued by Deputy Director, Veterinary Services, Raigarh (respondent No.3), amended on 09.05.2012 to provide selection by written examination. Following a private candidate's complaint of irregularities, the appointments of all 44 appointees (made against 32 advertised posts) were cancelled on 27.09.2012. In WPS No.4441 of 2012, by order dated 28.04.2023, the High Court set aside that cancellation on the footing that the whole select list should not have been scrapped, some candidates may have been selected genuinely, and only selections found individually illegal ought to be undone; it directed fresh show cause notices and individual examination, with removal only of those whose selection was found illegal and invalid. After two rounds of show cause notices (06.09.2024 and 04.10.2024), replies, and an enquiry report dated 04.03.2025 of a five-member committee, the authorities passed the impugned order dated 08.05.2025 (Annexure P-10) declaring the recruitment proceedings void and cancelling the appointments. Held: (i) the order dated 28.04.2023, not having been challenged, has attained finality and further proceedings had to conform strictly to its observations and directions; (ii) the authorities did not undertake the directed exercise of examining each appointee individually and considered only general irregularities; (iii) the impugned order, being in excess of the High Court's directions, is not sustainable and is quashed, respondents being at liberty to pass a fresh order in terms of the directives in WPS No.4441 of 2012; (iv) the finding of non-reservation of posts for women is erroneous, since the amendment reserved three posts for women, applications were open to male and female candidates alike, women candidates had applied and were appointed, and reserved posts could be filled from existing applicants; (v) for fresh recruitment of Clause-IV posts, the rules do not require publication of the select list in a newspaper calling for claims and objections.
