By way of the present petition, the petitioner is questioning the impugned order dated 22.08.2025, whereby his representation for payment of 90% provisional gratuity has been rejected.

Learned counsel for the petitioner submits that during the pendency of the present writ petition, the petitioner has been acquitted of all the charges levelled against him on 22.04.2026. Learned counsel further submits that the present petition may be disposed of with liberty to the petitioner to submit a representation before the Secretary concerned, stating the factum of his acquittal from the criminal charges along with all relevant documents and seeking release of retiral dues, as the petitioner has attained the age of superannuation in the year 2023.

Learned counsel for the State has no objection to the aforesaid submission made by learned counsel for the petitioner.

I have heard learned counsel for the parties, perused the pleadings and documents.

Having considered the submissions advanced by learned counsel for the parties and considering the limited prayer made by the petitioner, the present writ petition is disposed of with liberty to the petitioner to submit a representation before respondent No. 1 incorporating the subsequent events and additional facts, before the Secretary concerned within a

period of 20 days from today. In the event of filing of such representation, respondent No. 1 shall consider and decide the same in accordance with law, by passing a reasoned order within a further period of 45 days from the date of receipt of
