Heard Mr.S.P.Sahu, learned counsel for the petitioner as well as Mr.Sauyma Rai, learned Deputy Government Advocate appearing for the respondents/State.

The present petition has been filed by the petitioner with the

following prayers :-

“(i) That, this Hon'ble Court may kindly be pleased to issue a writ of mandamus, order or direction to the respondents police authorities be appropriate inquire/investigate the matter on complaint of the petitioner and to conclude the pending investigation and produce charge sheet and also to arrest the accused driver in lodging FIR at the earliest, in the interest of justice.

(ii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.”

From a perusal of the prayers and pleadings made in the instant petition, it transpires that the petitioner has prayed for issuance of a writ of mandamus or any other appropriate order or direction to the respondent police authorities to conduct an appropriate inquiry or investigation into the complaint filed by the petitioner, to conclude the pending investigation, to submit the charge sheet, and to arrest the accused driver at the earliest in connection with the FIR, but the particulars of the FIR, which has been lodged by him, has not been mentioned. This clearly shows that the prayer has been drafted by the learned counsel for the petitioner in a casual manner, thereby wasting the precious time of the Court. Accordingly, in the opinion of this Court, the prayer is defective.

Accordingly, the instant petition is dismissed on this ground alone with liberty to file afresh petition with appropriate prayer, subject to

depositing a sum of Rs.2,000/- as cost by the petitioner in the Registry of this Court and the same shall be transmitted to the Government School for Visual and Hearing Impaired, Tifra, District - Bilaspur (C.G.).

Certified copy of the documents annexed with this petition shall be returned to the counsel for the petitioner after retaining the photocopies of the same.
