The present writ petition has been filed under Articles 226 and 227 of the Constitution of India calling in question the legality and validity of the order dated 01.04.2021 passed by the Sub-Divisional Officer (Revenue), Manendragarh (respondent No.4), directing initiation of criminal proceedings, and the report dated 04.02.2021 submitted by the Tehsildar, Manendragarh (respondent No.5), with a prayer to quash the aforesaid proceedings and to grant consequential reliefs. The petitioner has filed the present petition seeking for the following prayer:-

“In view of the facts and grounds as mentioned in foregoing paragraphs, the petitioners pray for the following relief(s):

10.1 Call for entire records from the respondents for its kind perusal.

10.2 Issue writ(s) of certiorari quashing Impugned Orders dated 01/04/2021 (Annexure P-1) and

04/02/2021 (Annexure P-2).

10.3 Issue appropriate writ(s)/direction(s)/order(s) to respondents to compensate the petitioner and the cost of this litigation be also awarded.

10.4 That this Hon'ble Court be further pleased to pass any other order/orders, direction/directions in view of the facts and circumstances of the case, in favour of the petitioners against the respondents as it may deem fit in the facts and under the circumstances of the case.”

None appears on behalf of the petitioner to press this petition despite repeated calls.

It has been brought to the notice of this Court that by order dated 11.09.2024, this Court had directed that the present matter be listed after disposal of WPC No.1700 of 2015, as the issues involved herein were stated to be connected with the said writ petition. It has further been submitted that WPC No.1700 of 2015 has since been finally disposed of by the learned Single Judge vide order dated 14.11.2024 and, accordingly, the present matter has been listed today.

Despite the matter being called repeatedly, none has appeared on behalf of the petitioner to prosecute the case or to press the reliefs sought in the writ petition. The conduct of the petitioner clearly indicates that he is no longer interested in pursuing the present proceedings, particularly in view of the subsequent disposal of the connected writ petition. It appears that the cause for prosecuting the present petition has lost its significance by efflux of time.

Accordingly, the present writ petition is dismissed for non-prosecution on this ground alone, leaving it open to the petitioner, if so advised and if any surviving cause of action still subsists in law, to avail such remedy as may be available before the appropriate forum in accordance with law.

Interim order, if any, stands vacated.
