Learned counsel for the petitioners submits that petitioners are doing their business on the land of respondent- railways along with other similar vendors. He further submits that the petitioner is apprehending that he may be removed from the place where he is doing his business and hence, filed this petition.

2 . Considering the facts as pleaded therein, this Court vide order dated 05.01.2022 granted interim relief in favor of petitioner.

Learned counsel for the respondents submits that pursuant to the observation made by this Court during the course of hearing, he has sought instructions and according to the instructions, as of now, the respondents are not taking any steps for removing the petitioner from the place where he is doing his business. He also submits that the action at that time might have taken when the petitioner or other vendors have made an attempt to encroach the road, obstructed the free movement of the traffic. He submits that as of now, there is no such situation, therefore, no action will be taken against the petitioners, as per the instructions received by him today.

In view of the submission made by learned counsel for the respondents nothing survives in this writ petition for adjudication. Accordingly, this writ petition stands disposed of on the submission made by counsel for the respondent-railways.
