The petitioner has filed the instant petition seeking following

reliefs:-

“10.1 That the Hon'ble Court may kindly be pleased to direct the Respondents particularly the private respondent to submit a status report before this with regard to the incident of social boycott of petitioner.

10.2. That the Hon'ble Court may kindly further be pleased to issue a writ of mandamus directing the Respondent authorities to take immediate steps for allowing the petitioner in the mainstream of C.G. Manwa Kurmi Kshatriya Samaj and further to initiate criminal proceedings against the private respondent Nos. 7 and 8 with regard to the incident of social boycott as is evident from Annexure P-1.

10.3. That the Hon'ble Court may kindly be pleased to issue guidelines laying down measures with regard to prevention and control, criminal proceedings, rehabilitation of victims, in all social boycott cases of C.G. Manwa Kurmi Kshatriya Samaj as reflect from Annexure P-11, including measurers prayed for in para 9.7 of the petition.

10.4. That the Hon'ble Court may kindly be pleased to issue a writ of mandamus directing the Respondent authorities to constitute a committee to make recommendations on the enactment of a special law to deal with social boycott such as the Maharashtra.

10.5 That the Hon'ble Court may kindly be pleased to issue a writ of mandamus directing Respondents

formulate to a the special victim compensation and rehabilitation scheme for victims of social boycott.

10.6 That the Hon'ble Court may kindly be pleased to issue a writ of mandamus directing the State and District Legal Services Authorities to spread awareness on the existing legal provisions that address social boycott.

10.7 That the Hon'ble Court may kindly be pleased to issue a writ of mandamus directing the Respondent authorities to include components on social boycott and associated laws in the curriculum of judicial and police training programs.

10.8 That the Hon'ble Court may kindly further be pleased to grant any other order/relief as deem fit and proper looking to the facts and circumstances of the case in favour of the petitioner, in the interest of justice.”

At the outset, learned counsel for the petitioner submits that the main grievance is against respondent No. 7. It is submitted that during the pendency of the present petition, the then President of the C.G. Manwa Kurmi Kshatriya Community, Raipur, District Raipur (C.G.), who was arrayed as respondent No. 7, has passed away and a new President has since assumed office. In view of the changed circumstances, learned counsel seeks permission to withdraw the present petition with liberty to submit a fresh representation before the newly elected President for redressal of the petitioner's grievance. It is further submitted that, in the event the grievance is not redressed, the petitioner may be granted liberty to avail such remedy as may be available in law, including by filing an appropriate petition before this Court.

Learned State counsel submits that the ends of justice would be served if the petitioner is directed to submit a fresh representation

before the present President, who has assumed charge after the demise of the erstwhile respondent No. 7, for consideration of the petitioner's grievance in accordance with law.

Having heard learned counsel for the parties and considering the submissions made, this Court is of the opinion that the ends of justice would be served by permitting the petitioner to approach the newly elected President of the concerned Society by way of a fresh representation. Accordingly, the petitioner is granted liberty to submit a representation before the newly elected President of the C.G. Manwa Kurmi Kshatriya Community, Raipur, District Raipur (C.G.). Upon receipt of such representation, the competent authority shall consider and decide the same by passing a appropriate order in accordance with law, preferably within a period of 45 days. It is made clear that this Court has not expressed any opinion on the merits of the petitioner's claim. If the petitioner remains aggrieved by the decision so taken, he shall be at liberty to avail such remedy as may be available to him in accordance with law, including by approaching this Court, if so advised.

With this observation and direction, the petition stands disposed of.
