1. By filing the present petition, the petitioner has called in question the legality and validity of the impugned order dated 03.08.2026 (Annexure P-1), whereby the Fair Price Shop bearing ID No. 392007033, situated at Village Gangapur, Gram Panchayat Uchdih, Janpad Panchayat Lundra, District Surguja (C.G.), which was being operated by the petitioner, has been allotted to respondent No. 8. The petitioner has prayed for following reliefs:-
“10.1 Issue an appropriate writ, particularly a writ in the nature of Certiorari, quashing the impugned order dated 03.08.2026 (Annexure P-1), passed by respondent no. 7 whereby the fair price shop of the petitioner at Gangapur, Gram Panchayat Kuchdi, Janpad Panchayat Lundra, District Surguja, has been allotted to respondent No. 8;
10.2 Issue an appropriate writ, order or direction declaring the action of the respondents in inviting applications and proceeding with fresh allotment of Fair Price Shop ID No. 392007033 without first passing a lawful final order cancelling the petitioner's allotment to be illegal, arbitrary and violative;

10.3 Direct the respondents to restore/continue the petitioner's operation of Fair Price Shop ID No. 392007033, subject to the outcome of any proceedings initiated strictly in accordance with law;
10.4 Grant any other relief which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case; and ”
2. It is also brought to the notice of this Court that the very same petitioner, namely, Smt. Sonmati Prajapati, Secretary of Ujala Women Self Help Group, had earlier preferred W.P.(C) No. 4677 of 2026, in respect of the same subject matter, which has already been disposed of by this Court vide order dated 17.09.2026.
3. In view of the aforesaid earlier proceedings and disposal of the said writ petition, the present petition, arising out of the same cause of action, is not maintainable. Accordingly, the present petition is dismissed. No order as to costs.
