1. Petitioner, in this writ petition, prays for the following reliefs :-

“10.1 That, Hon'ble Court may please to issue a Writ of Mandamus or any other appropriate writ, order or direction, directing the Respondents, jointly and severally, to forthwith release and pay to the Petitioner the entire outstanding hire charges admittedly and legitimately payable in respect of vehicle Mahindra XUV-300 bearing Registration No.CG-31A-7893 till 21.06.2025, including, but not limited to, the sum admittedly under process for January-March, 2025 and the amount payable for the period 05.04.2025 to 21.06.2025 computed on a fair and just basis, together with interest thereon @ 12% per annum or at such rate as this Hon'ble Court may deem fit from the date each monthly bill fell due till the date of actual payment;

10.2 That, the Hon'ble Court may kindly be pleased to direct the Respondent Authorities to take action upon the representation made by the Petitioner and pass an appropriate order as per the law within a stipulated timeframe.

10.3 That, the Hon'ble Court may please to issue a Writ of Mandamus or any other appropriate writ, order or direction, directing the Respondents to constitute/depute an officer other than Respondent No.6 to verify and finally settle the Petitioner's outstanding bills within a time-bound period, in view of the conflict of interest here in Respondent No.6 verifying/certifying a claim arising out of his own default and conduct;

10.4 award costs of the present petition to the Petitioner; and

10.5 pass such other and further order(s) as this Hon'ble Court may deem just, fit and proper in the facts and circumstances of the present case, in the interest of justice.”

2. The petitioner has also filed an application for interim relief. Since the cause of action arises out of an agreement and the Clause No. 5 of the Agreement indicates that, the dispute which would arise from the said agreement, would be amenable to the arbitration, therefore, learned counsel for the petitioner prays for withdrawal of this writ petition to avail the remedy under the Arbitration and Conciliation Act, 1996 (for brevity, ‘the Arbitration Act’)

3. Accordingly, the writ petition is disposed of as withdrawn. The

petitioner, if so advised, may also seek remedy under the Arbitration Act. It may also seek for any interim relief under the Arbitration Act.
