The petitioner, in this Writ Petition, has prayed for the following reliefs:-

“10.1 Issue an appropriate writ, order or direction, particularly a writ in the nature of

mandamus, directing Respondent No.3, i.e. the learned Sub-Divisional Officer (Revenue), Rajpur, District BalrampurRamanujganj, to expeditiously conclude and decide Revenue Appeal Case No. 202507270700030/A-6/2025, preferred by the Petitioner under Section 44 of the Chhattisgarh Land Revenue Code, 1959;

10.2. Direct the concerned Respondents to ensure production/transmission of the original record before Respondent No.3 forthwith, so that the statutory appeal may proceed without any further avoidable delay;

10.3. Direct Respondent No.2 to decide the aforesaid appeal within a stipulated period, from the date of receipt of a certified copy of the order passed by this Hon'ble Court

10.4. Direct Respondent No.3 to avoid unnecessary adjournments and to decide the appeal strictly in accordance with law, on its own merits and after affording reasonable opportunity of hearing to all concerned parties;

10.5. Pass any other order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice.”

Learned counsel for the petitioner submits that he has filed an application under Section 44 of the CG Land Revenue Code before the concerned SDO, Rajpur, which has been pending since 26.06.2025. He

submits that the concerned SDO (Revenue), Rajpur, may be directed to decide the same expeditiously. He would further submit that due to requisitioning of the record, the matter is being adjourned again and again, therefore, the concerned SDO (Revenue) may be directed to call for the record immediately and to pass an appropriate order in accordance with law.

Learned State counsel has no objection to the limited prayer made by learned counsel for the petitioner.

Having considered the submissions made by learned counsel for the parties, the concerned SDO (Revenue), Rajpur, is directed to call for the relevant records in the case and decide the matter expeditiously in accordance with law, preferably within a period of 45 days from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the case.

With the aforesaid observations and directions, the present petition stands disposed of.
