By way of the present petition, the petitioners have prayed for following

reliefs:-

“10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records from the Office of Sub Registrar / Registrar relating to passing of impugned order dated 25.08.26.

10.2 This Hon'ble Court may kindly be pleased to set aside / quash the impugned order dated 25.08.26 (Annexure P-13) passed by the Registrar Durg and in turn direct the Sub Registrar to register the sale deed presented before it to be executed in favour of Smt. Archana Sharma.

10.3 This Hon'ble Court may kindly be pleased to grant any other relief which this Hon'ble Court may deem fit in the facts and circumstances of the present case including cost of the petition..”

Learned counsel for the petitioners submits that the dispute between the partners has already been resolved and an arbitral award has also been passed to that effect. However, the respondent/Registrar is not taking the aforesaid aspect into consideration and is not proceeding with the registration of the sale deed proposed to be executed in favour of Smt. Archana Sharma.

Learned State counsel submits that from the order dated 25.08.2026, it appears that the concerned Registrar has directed the petitioner to

appear along with the relevant documents, whereafter the sale deed would be processed in accordance with law, subject to due verification of the documents.

Heard learned counsel for the parties and perused the material available on record.

Considering the aforesaid facts and circumstances of the case and also taking note of the submission made on behalf of the petitioners that the dispute between the partners has already been resolved, the petitioner is directed to appear before the concerned Registrar along with all relevant documents.

Upon appearance of the petitioner and production of the relevant documents, the concerned Registrar shall consider the same and take an appropriate decision in accordance with law, after due verification of the documents and fulfilment of all requisite statutory formalities. If the concerned Registrar finds the documents and other requirements to be in order, the sale deed shall be processed and registered in accordance with law.

7. With the aforesaid observation and direction, the petition stands disposed of.
