The petitioner, in this Writ Petition, has prayed for the following reliefs:-

“10.1 That, the Hon'ble Court may kindly be pleased to quash the letter dated 24.07.2026 (Annexure P/1) issued by the respondent no. 3 and the letter dated 27.07.2026 (Annexure P/2) issued by the respondent no. 4, being illegal and arbitrary. In the interest of justice

10.2 That, this Hon'ble Court may kindly be please to issue the writ of mandamus commanding upon the respondent no. 2, 3 and 4 by directing them not to ask for suitability certificate from the petitioner college; as it is not necessary to obtain by the petitioner from the respondent no. 2, in the interest of justice.

10.3 That, the Hon'ble Court may kindly be pleased to call the entire record from the respondents, in the interest of Justice.

10.4 That, Any other order of orders or Direction or Relief though just and fit in the circumstances of the case may also kindly be granted.”

Learned counsel for the petitioner submits that the respondents have insisted upon a suitability certificate from the Indian Nursing Council, despite the petitioner-institution being duly recognized. He further submits that the petitioner has already submitted representations before

the concerned authorities, but no decision has been taken thereon, while counselling for admission to B.Sc. Nursing for the academic session 2026-27 is likely to commence shortly. He, therefore, prays that the petitioner-institution be permitted to continue with its recognition for the academic session 2026-27.

Learned counsel for respondents No.3 and 4 jointly submits that the suitability certificate would be essential and that the petitioner has to approach the concerned authority. They submit that after due verification of the faculty and other criteria, the concerned authority will recommend to respondent No.2 for grant of the suitability certificate, subject to the petitioner fulfilling all the criteria prescribed for the suitability certificate.

Learned counsel for the petitioner, at this stage, submits that the petitioner is willing to approach the concerned authority for necessary recommendation for obtaining the suitability certificate, in accordance with law.

Having considered the submissions made by learned counsel for the parties, the petitioner is directed to approach the concerned authority within a period of 15 days from the date of receipt of a copy of this order and in turn, the concerned authority shall consider the application and pass an appropriate order in accordance with law, after due verification of the conditions prescribed under the Indian Nursing Council (Minimum Pre-Requisites for Granting Suitability to Nursing Programs) Regulations, 2020. It is made clear that this Court has not expressed any opinion on the merits of the case. The concerned authority shall consider

and decide the application filed by the petitioner strictly in accordance
