Where a petitioner approaches the High Court in a writ petition challenging a revenue order, and there exists a statutory alternative remedy, the court may direct the petitioner to exhaust that remedy first without dismissing the petition on the ground of maintainability. In Revenue Case No. 05/A-1/2024-25, the petitioner sought to quash an order dated 08.05.2025 passed by the Additional Collector, Bilaspur, and directed correction of revenue entries under the Chhattisgarh Land Revenue Code, 1959. The State raised a preliminary objection based on the availability of an alternative remedy before the Commissioner. The Court granted liberty to the petitioner to avail the alternative remedy by approaching the competent Commissioner. The petitioner was directed to approach the concerned Commissioner within a period of 30 days from the date of the order. The writ petition and pending interlocutory applications were disposed of based on this observation.
