2. This writ petition has been preferred by the petitioner under Article 226 of the

Constitution of India, seeking following reliefs:-

“10.1 That, issue an appropriate writ, order, or direction, directing the respondent authorities to forthwith implement and execute the final order dated 27.02.2024 passed by the learned Nayab Tehsildar, Rajnandgaon, District Rajnandgaon in Revenue Case No.202302090400015/A-68, Year 2022-23, passed under Section 248(1) of the Chhattisgarh Land Revenue Code, 1959;

10.2 Direct the respondent authorities to give full effect to the aforesaid order dated 27.02.2024, as affirmed by the learned Sub-Divisional Officer (Revenue) vide order dated 09.10.2024 passed in Revenue Appeal Case No.202404090700040/A68, Year 2023-24;

10.3 Direct the respondent authorities to forthwith remove and evict respondents No.5 to 10 from the Government land bearing Khasra No.217/1, admeasuring 8.109 hectares, and Khasra No.318, admeasuring 2.051 hectares, situated at/along the Rajnandgaon-Khairagarh-Kawardha Main Road (State Highway), in accordance with law;

10.4 Direct the respondent authorities to ensure removal of all thelas/ferries, saloon, tea shop, pan shop, automobile parts shop, egg roll shop and other structures/encroachments illegally established by respondents No.5 to 10 over the aforesaid Government land;

10.5 Direct the respondent authorities to complete the entire exercise demarcation, removal of encroachment and restoration of the Government land within a time bound period, preferably within 15 days from the date of communication of the order of this Hon’ble Court;

10.6 Direct the respondent authorities to submit a compliance report before this Hon’ble Court after actual removal of the encroachments;

10.7 Any other relief, which may be deemed fit and proper in the facts and circumstances of the case, may also be allowed. ”

Learned counsel for the petitioner submits that as per the relief clause, petitioner has prayed for the direction to the respondent authorities to implement and execute the final order dated 27.02.2024 passed by the concerned Nayab Tehsildar and remove the encroachers within the stipulated period.

4. Learned counsel appearing for the State/respondents has no objections with regard to the limited prayer made by the counsel for the petitioner.

Considering the aforesaid aspect of the matter, particularly considering the relief clause prayed by the petitioner, it would be appropriate to direct the Collector, Rajnandgaon (C.G.) to consider the grievance of the petitioner in light of the order passed by the concerned Nayab Tehsildar. Accordingly, the instant writ petition is disposed of directing the concerned Collector to pass an appropriate direction to the concerned Tehsildar to implement and execute the final order dated 27.02.2024.

6. With the aforesaid direction, the instant writ petition stands disposed of.
