The petitioner has filed this petition with the following reliefs:-

“ 10.1 That, the Hon'ble Court may kindly be pleased to direct respondent no 3 to release

the aforesaid Payment/Bill amount to petitioner immediately with due interest and cost.

10.2 That, the Hon'ble Court may kindly be pleased to direct respondent no 3 to decide the representation of petitioner (Annexure P/1) within stipulated time.

10.3 To issue any other order(s), direction(s), writ(s) which the Hon'ble Court deems fit and proper in the interest of justice.

Learned counsel appearing for the petitioner submits that pursuant to the supply order issued in favour of the petitioner, the petitioner supplied 20 metric tonnes of unbranded Alumino-Ferric of Grade-II, worth Rs. 4,80,000/- (Rupees Four Lakh Eighty Thousand only), to the Municipal Council, Manendragarh, District Manendragarh-Chirmiri-Bharatpur, Chhattisgarh, on 19.03.2026. However, despite submission of the requisite bills and other necessary documents, the payment against the said supply has

not been made till date. It is further submitted that the petitioner has submitted representations dated 30.04.2026, 02.06.2026 and 21.08.2026 before the concerned authority seeking payment of the outstanding amount payable by the Municipal Council, Manendragarh. However, despite submission of the aforesaid representations, the same have not been considered or decided till date. Hence, the present petition has been filed by the petitioner.

Learned State Counsel submits that the contesting party is the Municipal Council and therefore, the appropriate order in the matter is required to be passed by the Municipal Council.

Considering the aforesaid aspect of the matter and the fact that the petitioner has supplied the materials pursuant to the supply order issued by the Municipal Council, the concerned authority is required to consider the petitioner's claim for payment. Accordingly, the representations submitted by the petitioner shall be considered and decided by the concerned authority in accordance with law. If there is no dispute with regard to the supply of the materials, the concerned authority shall ensure payment of the amount due to the petitioner against such supply within a period of 60 days from today. It is made clear that this Court has not expressed any opinion on the merits of the petitioner's claim and the aforesaid direction is being issued on the basis of the documents placed on record by the petitioner indicating that there is no dispute with regard to the supply of the materials as requisitioned by the

With the aforesaid directions and observations, the petition stands
