1. By way of this writ petition, the petitioner has prayed for the following relief(s) :-

“10.1 That, the Hon'ble Court may kindly be pleased to allow the instant writ petition and the respondent authorities may kindly be directed to provide the information sought by the petitioner in his application (Anne. P-1) within 15 days, in the interest of justice.

10.2 That, the Hon'ble Court may kindly be pleased to direct the strict action against the respondent no. 1, 3 & 4 for not providing the information to the petitioner under RTI Act for more than 4 1½ years, in accordance with law, in the interest of justice.

10.3 That, the Hon'ble Court may kindly be pleased to call for the records of the present case, in the interest of justice.

10.4 That, the Hon'ble Court may kindly be pleased to grant any other relief, which is deems fit and proper.”

Learned counsel for the petitioner submits that the second appeal filed by the petitioner/information seeker under the Right to Information Act, 2005, is pending before the concerned Second Appellate Authority, i.e. the Chief Information Commissioner, since 19.04.2022. It is further submitted that, despite the second appeal having remained pending for a considerable period, the concerned authority has fixed the matter for the next date of hearing on 08.07.2027.

Upon being apprised of the aforesaid facts, learned State counsel submits that, in view of the considerable delay in disposal of the second appeal, the concerned authority ought not to have fixed such a distant date and that the second appeal deserves to be considered and decided expeditiously, in accordance with law.

4. Learned counsel appearing for Respondent No.1 as well as State submits that the second appeal pending before the concerned authority shall be considered and decided within a period of 15 days.

5. I have heard learned counsel for the parties and perused the material available on record.

Considering the aforesaid facts and circumstances of the case, particularly the fact that the second appeal filed by the petitioner under the Right to Information Act, 2005, has been pending before the concerned Second Appellate Authority since 2022, the concerned Second Appellate Authority is directed to consider and decide the said second appeal, in accordance with law, within a period of 15 days from the date of receipt of a copy of this order.

7. The concerned Second Appellate Authority shall thereafter submit a compliance report, along with a personal affidavit, before the Registrar (Judicial) of this Court.

8. In view of the above, the present petition stands disposed of .
