This Writ Petition has been filed for the following reliefs:-

"(i) That, this Hon'ble Court may kindly be pleased to set aside the impugned amended order dated 07.01.2026 (ANNEXURE P/1)passed respondent no.3 so far as it relates to direction of registration of FIR given to SDO (R).

(ii) That, this Hon'ble Court may kindly be pleased to set aside order dated 26.11.2025 (ANNEXURE P/2) issued by Respondent no.3, and give opportunity of hearing the petitioner.

(iii) That, this Hon'ble Court may kindly be pleased to direct the respondent no.02 (Commissioner Surguja Division) to accept the revision filed by the petitioner and decide the same in merits.

(iv) That this Hon'ble court may kindly be pleased to grant any other relief which this Hon'ble Court may deem fit with regard to this case."

As per notice-sheet of the Registry dated 02.02.2026, the manner in which relief has been sought by the petitioner, the classification of the case ought to have been Writ Petition (Criminal).

In the circumstances, learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to file appropriate petition in accordance with law.

Considering the aforesaid submission, this petition is dismissed as withdrawn reserving the liberty as prayed for.
