The petitioner has filed the instant petition for following reliefs:-

“10.1 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to decide the application of the petitioner & consider the case of the petitioner for grant of lease (patta) in favour of the petitioner.

10.2 Cost of the petition may also be granted to the petitioners.

10.3 Any other relief, which this Hon’ble Court deems fit and proper, may also kindly be granted to the petitioners, in the interest of justice.”

Learned counsel for the petitioner submits that he has applied for grant of patta for a small piece of land admeasuring 500 sq. ft., being part of Plot No. 64/1, Sheet No. 58, having a total area of 69,957 sq. ft. situated on the Shahid Chowk–Shitala Mandir Road. He further submits that, pursuant to the said application, the Revenue Inspector, vide report/order dated 11.08.2021, assessed the premium payable for grant of the patta at Rs. 13,71,479/-, and the said entire amount was duly deposited by the petitioner on 22.09.2021. It is further submitted that the objection raised by one Leelambar Prasad Kashyap with regard to the proposed grant of patta was rejected by this Court in W.P. (C) No. 4820 of 2021. Thereafter, the proceedings for grant of lease/patta in favour of the petitioner were initiated. Despite the petitioner having deposited the entire amount as demanded, the competent authority has neither concluded the proceedings nor granted the patta in his favour till date, as such this petition has been filed.

Learned counsel appearing for the State/respondents, on the basis of instructions received from the competent authority, submits that the petitioner's application for grant of patta shall be considered and, if no legal impediment exists, the patta shall be granted within a period of 60 days.

Heard learned counsel for the parties and perused the material available on record.

Considering the facts and circumstances of the case, this Court finds that the petitioner had deposited the entire requisite consideration amount in the year 2021 and has been awaiting the grant of patta ever since. It is also not disputed that the objection raised by Leelambar Prasad Kashyap has already been rejected by this Court. In the absence of any other legal or factual impediment brought to the notice of this Court, there remains no justifiable reason to withhold the grant of patta. Accordingly, the respondent authorities are directed to issue the patta in favour of the petitioner within a period of 60 days from the date of receipt of a copy of this order.

With this observation and direction, the petition stands disposed of.
