This petition has been preferred by petitioners under Article 226 of the Constitution of India seeking following reliefs:-

“10.1 That, this Hon'ble Court may be kind enough in issuing a writ in the nature of mandamus, certiorari or likewise any other appropriate writ, order or direction directing the Respondents State to re-open and extend the counselling process for admission to the B.Sc Nursing Courses for the academic session 2025-26 for a further period of one month beyond 31.12.2025;

enough in issuing a writ in the nature of mandamus, certiorari or likewise any other appropriate writ, order or commands, commanding and directing the Respondents to relax the eligibility criterion prescribing a minimum cut-off of 10 percentile upto 5 percentile/percentage, and to permit participation of petitioner on the basis of marks/percentage, in accordance with the Chhattisgarh Nursing Course Admission Rules, 2019 (as amended in 2022) and the guidelines issued by the Indian Nursing Council; and allow petitioners to enroll them for counselling on their official website. 10.3 That, this Hon'ble Court may be kind enough in issuing a writ in the nature of mandamus, certiorari or likewise any other appropriate writ, order or commands, commanding and directing respondents which the Hon'ble Court deems fit and proper looking to the facts and circumstances of the case, may also be granted.”

In this petition, the petitioners who are the students aspiring their carrier in the field of nursing made a prayer that last date fixed for admission for the first year of Nursing Course on 31.12.2025 may be extended to the convenience to the petitioners.

Learned counsel appearing for the petitioners would submit that the petitioners have secured less marks in the nursing admission conducted by the Chhattisgarh Professional Examination Board (VYAPAM), Raipur, as such earlier there were no occasion to get admission and subsequently on 29.12.2025, the responded No. 6 has reduced the percentage for getting admission in the nursing course.

Learned counsel would further submit that since the percentage has been reduced therefore, an opportunity to the petitioners has come for admission in the nursing course and would pray for extending last cut off date i.e. on 31.12.2025 which has already expired. He would

further submit that the guidelines issued by Nursing College of India have not been followed in spirit and non-compliance of that order may vitiate the entire action taken by the State Government.

On the other hand, learned counsel for Respondent No. 6 would submit that since Nursing Council of India has not extended last date for admission, as such this Court cannot grant any relaxation, as it is prerogative of Nursing Council of India. He would further submit that in catena of judgments, the Hon'ble Supreme Court has examined the issue where the cut off date has not been extended by the High Court under Article 226 of the Constitution of India, and observed that in professional course, no last date can be extended by the High Court and it is within the domain of highest body of the faculty in the case of Dental admission, Dental council of India as well as in surgery, National Medical Commission of India, as such the writ petition is not maintainable at this juncture and would pray for dismissal of the writ petition.

I have heard counsel for the parties and perused the material available on records.

Considering the submission made by the respective parties and the law laid down by the Hon'ble Supreme Court and also considering the fact that vide Annexure P/2 dated 29.12.2025, though the percentage has been reduced by the Nursing College of India, it has not extended the time period and the time period has already expired on 31.12.2025 itself, therefore, no writ of mandamus can be issued to the respondents to extend the cut off date for admission in nursing course, as it is within the domain of Nursing Council of India/ Respondent No. 6, hence, I am of the view that no case is made out for interference in exercise of

inherent jurisdiction of this Court under Article 226 of the Constitution of India. Accordingly, the writ petition is sans merit and it is dismissed .

Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
