Heard Mr. Jai Prakash Shukla, learned counsel for the petitioner. Also heard Mr. Prasun Bhaduri, learned Deputy Advocate General for respondents No.1 / State as well as Mr. Bhupendra Singh, learned counsel for respective respondent.

The present petition has been filed by the petitioner seeking following relief:

“10.1 That this Hon'ble Court may kindly be pleased to direct the respondent authorities to call the entire records pertaining to this case.

10.2 That the Hon'ble Court may kindly be pleased to issue writ in the nature of certiorari, prohibition and mandamus, directing the respondent authorities to cancel the NIT published dated 3009-2022 (Annexure P/1) and entire tender process/consequences arising out of it by declaring it as unconstitutional, illegal, arbitrary and as an alternate if the NIT published dated 3009-2022 and its entire process is not so cancelled then at least petitioner be permitted to participate in the tender and after his participation only the further process, be carried on, leading to work order.

10.3 Hon'ble court may kindly further be pleased to direct the respondent authorities to decide the pending representation dated 17-05-2023 of the petitioner in accordance with law assigning valid and lawful reason.

10.4 Hon'ble court may kindly further be pleased to direct the respondent authorities to conduct independent enquiry into the matter as to why and on whose instance petitioner has been prevented from participating in the tender process and to take stern lawful action against the culprit and further to pass any order which deems fit including cost of the petition in the interest of Justice.”

Learned counsel for the petitioner submits that the matter has become infructuous.

In view of the submission made by learned counsel for the petitioner, the present petition is dismissed as having become infructuous .
