Heard Mr. Abhinav Kardekar, learned counsel for the petitioner. Also heard Mr. Sourabh Sharma, learned counsel, appearing for respondent No.1 as well as Mr. A.A. Laxmidhar, learned counsel, appearing for respondent No.2 / Caveator.

The present petition has been filed by the petitioner under Article

226 of the Constitution of India, with the following prayers :-

“10.1 To kindly hold that the allotment of dealership of Respondent No. 1's Petrol Pump Retail Outlet to Respondent No. 2 in the Tamnar-Milupara Road, Raigarh (C.G.) is erroneous for being violative of the Selection Guidelines dated 10.06.2023 as well as the Resitement Guidelines dated 09.04.2025;

10.2 To kindly hold that the actions of the Respondent No. 1 in allotting petrol pump outlet in favour of Respondent No. 2 in Tamnar Milupara Road, Raigarh (C.G.) are in contravention of the terms of the advertisement/tender dated 28.06.2023 (ANNEXURE P/3) and other applicable laws;

10.3 To kindly hold that the actions of the Respondents are in contravention of the applicable principles of law;

10.4 To kindly direct the Respondent to not take any steps in furtherance of opening up of the Petrol Pump Retail Outlet belonging to the Respondent No. 2 at Tamnar-Milupara Road, Raigarh (C.G.);

10.5 To kindly be pleased to award the costs of this Petition in favour of the Petitioner;

10.6 To pass any other order as the Hon'ble Court may deem fit in the interest of justice.”

Learned counsel for the petitioner submits that he seeks to withdraw the instant petition with liberty to file a fresh petition, as one of the important document has not been filed.

It appears that the instant petition has been filed by the petitioner in a casual and half-hearted manner without annexing the relevant document. At an earlier stage, he prayed for withdrawal of the petition; however, when this Court expressed its inclination to impose a cost of Rs. 50,000/- upon the petitioner for filing the

petition in such a casual manner and for wasting the precious time of the Court, he instead chose to argue the matter. Such conduct cannot be appreciated.

After the passing of the order, learned counsel for the petitioner tendered an oral unconditional apology and submits that he withdraws his submission with regard to arguing the matter on merits.

Considering the above submission made, this Court is inclined to take a lenient view in the interest of justice. The oral unconditional apology tendered by learned counsel for the petitioner is accepted and he is permitted to withdraw the instant petition with liberty to file a fresh petition in accordance with law.

It is, however, observed that due care and diligence must be exercised while filing petitions, and such lapses should not be repeated in future.

Accordingly, the petition stands dismissed as withdrawn with liberty as prayed for subject to depositing a sum of Rs.50,000/(fifty thousand only) as cost by the petitioner before the Registry of this Court and submit a receipt of the same at the time of filing of the fresh petition, if any, and the amount so deposited, if any, shall be transmitted to the Government Home for Mentally Underdeveloped Children Mana Camp, District - Raipur (C.G.).
