The petitioner, in this Writ Petition, has prayed for the following reliefs:-

“a. This Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus or suitable direction to the respondent authorities for quashing the impugned order, dt.17/09/2020 AnnexureP/1.

b. May kindly be pleased to direct the respondents for grant of permission to supply the ready to eat diet material in the Sector Kendua, Block - Saraipali, District – Mahasamund.

c. May kindly be pleased to allow the compensation to the petitioner SwaSahayata Samoohand any other relief as the Hon'ble Court may be deemed fit and proper. d. Cost of petition may be allowed.”

Learned State counsel submits that against the cancellation of the supply of ready-to-eat material, an appeal lies before the concerned District Collector, which remedy has not been availed by the petitioner. He further submits that in view of the availability of an alternative remedy under the Rules, the present petition may not be adjudicated and the petitioner may be directed to avail the remedy of appeal before the concerned authority.

Considering the aforesaid submission and the availability of an alternative remedy of appeal before the concerned District Collector, this Court is not inclined to entertain the present petition at this stage.

Accordingly, this petition is disposed of with liberty to the petitioner to

avail the remedy of appeal before the concerned District Collector, in accordance with law.
