Present is a writ petition filed by the petitioner under Article 227 of the Constitution of India for a limited prayer that a civil suit has been pending since 17.06.2025 and despite repeated opportunity granted to the plaintiff for production of his witnesses, she has not produced her witnesses, and therefore, the learned trial Court may be directed to expedite the proceedings of the case and conclude the same within the stipulated time frame.

I have heard learned counsel for the petitioner and perused the document annexed with the writ petition.

From perusal of the order sheets of the learned trial Court (Annexure P-1), it transpires that the civil suit has been filed on 17.06.2025 by the plaintiff and summons were ordered to be issued on 25.06.2025, the defendant No.1 has made his appearance on 24.07.2025, and thereafter, the case was further adjourned for service of summons upon other defendants. The written statements have been filed by the respective defendants on 11.11.2025 and then the issues have been framed on 21.11.2025, thereafter, the case was fixed for 19.12.2025, 13.02.2026, 25.02.2026, 07.03.2026, 23.03.2026, 22.04.2026, 15.05.2026 and 18.06.2026.

When an specific query has been asked from the learned counsel for

the petitioner, as to what transpires on 18.06.2026 on the date of hearing of the case, he would submit that the evidence of the plaintiff has not been recorded and the case is further adjourned.

Considering the submissions made by learned counsel for the petitioner as well as from perusal of the order sheets of the learned trial Court that despite repeated adjournments for plaintiff’s evidence, the same could not be recorded, therefore, it would deem appropriate to direct the learned trial Court to expedite the trial of the case and conclude the same within stipulated time frame.

Accordingly, the learned trial Court is directed to expedite the trial of the Civil Suit No. A/59/2025 pending before it and shall conclude the same within the outer limit of eight months from the next date fixed before it, after giving proper opportunity of hearing to the parties in accordance with law.

With the aforesaid observation and direction, the present writ petition is disposed of .
