1. At the outset, learned counsel for the petitioner would submit that the present writ petition is arising out of the appellate proceeding, whereas the appellate proceeding has already been terminated and the matter has been remitted back to the learned trial Court and therefore, he may be permitted to not press the present writ petition with liberty to avail the remedy of filing appropriate application for impleadment of necessary party before the learned trial Court.

2. Learned counsel for the Respondent No. 4 and 5 is not opposes the withdrawal of the present writ petition, however, he would submit that the application, so filed by the petitioner before the learned trial Court, may be decided on its own merits.

3. In view of the submissions made by learned counsel for the petitioner, the present writ petition is dismissed as not pressed, however, he is at liberty to make his application before the learned trial Court and the learned trial Court is directed to decided the application filed by the petitioner in accordance with law on its own merits.
