Heard Mr. Mateen Siddiqui, learned Senior Advocate assisted by Ms. Apoorva Pandey, learned counsel for the appellants. Also heard Ms. Anuja Sharma, learned Deputy Government Advocate for respondents N.1 & 2 / State as well as Mr. Avinash Singh, learned counsel for respondents No.3 & 4.

The present intra Court appeal has been filed against the order dated 20.08.2026 passed by the learned Single Judge in W.P.(S) No. 6260/2026, whereby the writ petition filed by the writ petitioners / appellants herein was dismissed by the learned Single Judge.

After arguing the matter for some time, learned Senior Counsel appearing for the appellants submits that, in view of the observation made by the learned Single Judge in paragraph 8 of the impugned order, the present appeal may be disposed of with liberty to the appellants to submit a representation before the concerned authority. He further prays that the concerned authority may be directed to consider the said representation expeditiously.

Learned counsel appearing for the State supports the impugned order. However, she submits that, as learned counsel for the appellants is seeking liberty to submit a representation before the concerned authority, she has no objection to the said prayer.

We have heard learned counsel for the parties and perused the impugned order and materials available on record.

In view of the submission made by learned Senior Counsel appearing for the appellants, the present appeal is disposed of with liberty to the appellants to submit a representation before the concerned authority. In case such representation is submitted, the concerned authority shall consider the same expeditiously, keeping in mind the fact that advertisement for recruitment has already been issued/published.

Accordingly, the present appeal stands disposed of .
