This is the first bail application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of anticipatory bail to applicant who is apprehending his arrest in connection with Crime No.583/2025 registered at Police Station Balco Nagar, District Korba (C.G.) under Section 376 of IPC.

Case of prosecution, in brief, is that the complainant lodged report in concerned police station alleging that applicant somehow obtained her mobile number and started making calls on her mobile regularly. After few days, the applicant told her on phone that he liked her and wanted to marry her. On being called by applicant, she went to meet him in nearby jungle on 15.4.2024 at 9:00 p.m. where the applicant established physical relations with her for the first time and thereafter he continued to have physical relations with her. Later on, the applicant refused to keep her. Based on aforementioned allegations, police registered the crime in question against the applicant.

Learned counsel for applicant would submit that applicant is innocent, he has been falsely implicated in this case and he has not committed any offence as alleged. Even if the allegations levelled against the applicant are considered on its face value, it is apparent that the victim on the date of first incident was major and she has developed physical relation with applicant out of her own free will and consent. He next contended that applicant is of tender age of 20 years, there is no criminal antecedent against him and hence, he may be extended benefit of anticipatory bail.

On the other hand, learned State counsel opposes the submission of learned counsel for applicant. However, upon specific query being put with regard to age of victim, he

submits that according to documents available in case diary, she was about 19 years old on 9.9.2025. Further, he does not dispute submission of learned counsel for applicant that there is no criminal antecedent against the applicant.

Heard learned counsel for the parties.

On due consideration on the submission of learned counsel for respective parties, nature of allegations and age of the victim on 9.9.2025 to be about 19 years, as submitted by learned State Counsel after going through case diary, and further considering that there is no other criminal antecedent against him, without commenting anything on merits of the case, I am inclined to release the applicant on anticipatory bail.

Accordingly, the anticipatory bail application is allowed. It is directed that in the event of arrest of applicant in connection with aforementioned crime, he shall be released on bail his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. The applicant shall also abide by the following conditions :-

(i) that the applicant shall make himself available for interrogation before the investigating officer as and when required;

(ii) that the applicant shall not, directly or indirectly, make any inducement, threat or promise to any person

acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police officer;

¶32

(iii) that the applicant shall not act, in any manner, which will be prejudicial to fair and expeditious trial; and

iv) that the applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of trial.
