This is the first bail application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of anticipatory bail to applicant who is apprehending his arrest in connection with Crime No.253/2025 registered at Police Station Kotwali, District Rajnandgaon (C.G.) under

Sections 296, 109, 3 (5) 351(3), 191 (2), 191 (3), 190 of the Bharatiya Nyay Sanhita 2023 (BNS).

Case of prosecution, in brief, is that on 23.5.2025 complainant lodged report in concerned police station to the effect that applicant along with other accused persons with intent to kill her husband, assaulted him by means of hands, fists & knife and caused grievous injuries. Based on aforementioned allegations, police registered the crime in question against the applicant and other accused persons.

Learned counsel for applicants would submit that applicant has been falsely implicated in this case and he has not committed any offence as alleged. Though applicant was present on the spot, he has not participated in any manner in commission of offence. Applicant has been made accused in the present case only on the basis of memorandum statement of other accused persons. There is no other criminal antecedent against the applicant, hence, he may be extended the benefit of anticipatory bail.

On the other hand, learned State counsel opposes the submission of learned counsel for applicant and would submit that there are seven accused persons including a juvenile. Applicant was spotted at the spot and he assaulted the injured by means of knife. Upon putting specific query with regard to the accused who assaulted injured by means of

knife, after reading the police statement of injured Deepesh Dheemar, learned State Counsel submits that allegation of assault by means of knife is against accused Akash Markam. On putting further query regarding criminal antecedent of applicant, he submits that there is no other criminal antecedent against the applicant.

Heard learned counsel for the parties.

On due consideration on the submission of learned counsel for respective parties, nature of allegations and further considering that allegation of giving knife blow is against accused Akash Markam, no overtact of applicant is stated by the injured and there is no other criminal antecedent against him, without commenting anything on merits of the case, I am inclined to release the applicant on anticipatory bail.

Accordingly, the anticipatory bail application is allowed. It is directed that in the event of arrest of applicant in connection with aforementioned crime, he shall be released on bail his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. The applicant shall also abide by following conditions :-

(i) that applicant shall make himself available for interrogation before the investigating officer as and when required;

(ii) that applicant shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police officer; (iii) that applicant shall not act, in any manner, which will be prejudicial to fair and expeditious trial; and

iv) that applicant shall appear before the trial Court on

each and every date given to him by the said Court till disposal of trial.
