This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 149/2026 registered at Police Station – Balrampur, District – Balrampur-Ramanujganj (C.G.) for the offences punishable under Sections 115 (2), 121 (1), 132, 221 and 296 of BNS.

Case of the prosecution is that on 19.08.2026, at about 03:00 p.m., when the complainant, Assistant Engineer of CSPDCL, went to the house of Kusum Devi, who is having electricity connection with B.P. No. 1007690581, and requested entry into the house to inspect the meter, the same was objected to by the applicant. When the complainant entered into the house, he found that the electricity supply was bypassed meter. While officers were preparing the case, applicant assaulted the Junior Engineer, Murli Dhar Verma, upon which he suffered injuries. Based on the report, aforementioned crime was registered against the applicant.

3. Counsel for the applicant submits that the applicant has been falsely implicated in the crime in question. He is working with the Labour Department and is a government servant. Though some altercation of words took place between them, the applicant did not assault any of the officials. He submits that the injury received by the complainant was caused because he fell down. There are no criminal antecedents of the applicant, and the applicant would suffer in his service career also, if benefit of anticipatory bail is not extended to them.

4. On the other hand, learned State counsel opposes the submission and submits that, from the allegations, it is apparent that the applicant assaulted an employee of the Electricity Department, in which the complainant suffered injuries over his

shoulder and right eye. Upon a specific query regarding the criminal antecedents of the applicant, he submits that there is no mention of any criminal antecedents.

5. I have heard learned counsel for the parties and perused the material available on record.

6. Taking into consideration the facts and circumstances of the case and the nature of the allegations, and further considering that the applicant is working with the State Government in the Labour Department, without commenting on the merits of the case, I am inclined to allow this application.

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Pradeep Kumar Sharma , on executing a personal bond and one local surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:-

(a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court.

(b) he shall not act in any manner which will be prejudicial to fair and expeditious trial.

(c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.

(d) the applicant and the surety shall submit a copy

of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.

(e) he shall not involve themselves in any offence of similar nature in future.
