This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants who have been arrested in connection with Crime No. 193/2026 registered at Police Station Nandani Nagar, District Durg (C.G.), for the offence punishable under Section 34(2) of Excise Act.

Case of the prosecution, in brief, is that the applicants were found in possession of 45.900 bulk liters of foreign liquor illegally, thereafter a case

was registered against the applicants and they were arrested.

Learned counsel for the applicants submits that the present applicants have been falsely implicated in this case. It is further argued by him that there is no eye witnesses in the case and the applicants have been arrested only on the basis of apprehension and the offence is trialable by the Judicial Magistrate First Class. He further submits that the applicants are in jail since 16.06.2026, charge-sheet has been filed and trial is likely to take quite long time for its conclusion. It is further argued that with regard to three other criminal antecedents of applicant No. 1, in one case he has been acquitted, one case was disposed of with a fine, and one case is pending. He also submits that other co - accused, namely, Tamradhawaj Kumar Dhruv and Javed Tandon have already been granted regular bail by this Court in MCRC No. 7091 of 2026 vide order dated 24.08.2026, therefore, the present applicants are also entitled to be grant of regular bail on the ground of parity.

On the other hand, learned counsel for the State would oppose the bail application and submit that the charge-sheet has been filed in the present case before the competent Court.

I have heard learned counsel appearing for the parties and perused the case diary.

Having considered the facts and circumstances of the case, nature and gravity of allegation levelled against the present applicants and the fact that the charge-sheet has already been filed before the competent Court and they have been in jail since 16.06.2026. Further the applicant No. 1 has 3 criminal antecedents, out of the said three cases, he has already been acquitted in one case, one case was disposed of with a fine, and the remaining one case is

pending. Also considering the fact that the co - accused, namely, Tamradhawaj Kumar Dhruv and Javed Tandon have already been granted regular bail by this Court in MCRC No. 7091 of 2026 vide order dated 24.08.2026, therefore, this Court is of the view that the applicants are entitled to be released on bail in this case on the ground of parity.

Accordingly, the regular bail application is allowed and it is directed that in the event of the applicants executing a personal bond for a sum of Rs.50,000/- each with one surety in the like sum to the satisfaction of the concerned trial Court, they shall be released on bail on the following conditions:-

(i) they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court;

(ii) they shall not act in any manner which will be prejudicial to fair and expeditious trial, &

(iii) they shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.

Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
