The applicant has preferred this First Bail Application under Section 483 the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No. 47/2026 registered at Police Station Civil Line, Bilaspur (C.G.) for the offence under Sections 331(4), 305, 317(2) & 3(5) of BNS.

The case of the prosecution, in brief, is that on 11.1.2026, the complainant reported that, in the intervening night of 10/11.1.2026, some unknown persons had entered the complainant's house and stolen one gold necklace, one gold mangalsutra, gold ear tops, one gold locket, and three old silver anklets. Thereafter, an offence/FIR was registered against the applicant, and he was arrested in connection with the aforementioned crime.

Learned counsel for the applicant would submit that the applicant is innocent and has been falsely implicated in this case. He would further submit that the applicant is the sole earning member of his family and is facing financial hardship. The applicant is in jail since 5.4.2026, and the conclusion of the trial is likely to take some time. Therefore, the instant bail application may kindly be allowed.

On the other hand, learned State counsel submits that gold ornaments, including a mangalsutra and ear tops, valued at Rs. 1,40,000/-, were seized from the possession of the applicant, and some of the articles were identified by the complainant, Kamlesh Kumar Netam. The applicant sold the ornaments at a jewellery shop in Katni, Madhya Pradesh, and obtained a receipt. As per the memorandum statement, some of the ornaments were deposited with Manappuram Finance Limited, Bilaspur, against which the applicant obtained a loan, and as per the bank statement, the loan amount was transferred to the applicant's bank account. Therefore, the present bail application deserves to be rejected.

I have heard learned counsel for the parties and perused the case diary.

Having considered the fact that seven criminal cases of a similar nature, registered during the years 2025–26, and one criminal case registered under the Gambling Act at Police Station Civil Lines on different dates are pending consideration before the competent Court, and that, in some of the cases, the stolen articles were identified by their respective owners, and further considering the fact that the applicant is a habitual offender and that the stolen articles were seized from his possession at his instance, I am not inclined to grant bail to the applicant.

Accordingly, the bail application of the applicant is rejected .
