The applicant has preferred this First Bail Application under Section 483 the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No. 1390/2025 registered at Police Station Civil Line, Bilaspur (C.G.) for the offence under Sections 331(4), 305, 317(2) & 3(5) of BNS.

The case of the prosecution, in brief, is that on 24.11.2025, the complainant reported that, in the intervening night of 23/24.11.2025, some unknown persons had entered the complainant's house and stolen two gold earrings, one gold chain, two rings, two silver plates, etc. Thereafter, an offence/FIR was registered against the applicant, and he was arrested in connection with the aforementioned crime.

Learned counsel for the applicant would submit that the applicant is innocent and has falsely been implicated in this case. He would further submit that the applicant is the sole earning member of his family and is facing financial hardship. The applicant has been in jail since 5.4.2026, and the conclusion of the trial is likely to take some time. Therefore, the instant bail application may kindly be allowed.

On the other hand, learned State counsel submits that gold and silver ornaments, including mangalsutra, two gold earrings, one gold chain, two rings, two silver plates and payal, debit cards, ATM cards, a Scooty, a screwdriver, etc., were seized from the possession of the applicant, and some of the articles were identified by the complainant, Vinod Pathak. The applicant sold the ornaments to one co-accused, namely, Sunny Soni, who runs a jewellery shop. As per the memorandum statement, the applicant admitted to having committed thefts at different places, and cash amounting to Rs. 72,000/- was also recovered at his instance. Therefore, the present bail application deserves to be rejected.

I have heard learned counsel for the parties and perused the case diary.

Having considered the fact that seven criminal cases of a similar nature, registered during the years 2025–26, and one criminal case

registered under the Gambling Act at Police Station Civil Lines on different dates are pending consideration before the competent Court, and that, in some of the cases, the stolen articles were identified by their respective owners, and further considering the fact that the applicant is a habitual offender and that the stolen articles were seized from his possession at his instance, I am not inclined to grant bail to the applicant.

Accordingly, the bail application of the applicant is rejected .
