1) Since these bail applications arise out of the same crime number, they are being disposed of by this common order.

2) The applicants have preferred these First Bail Applications under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail. They have been arrested in connection with Crime No. 218/2025 registered at Police Station Baikunthpur, District Koriya (C.G.), for the offences punishable under Sections 111, 317(2), 317(4) and 317(5) of the BNS, 2023.

3) The case of the prosecution, in brief, is that on a letter received from

the office of the Inspector General of Police, SIV/CCTNS/Cyber Crime, Police Headquarters, Nava Raipur, Chhattisgarh, directing legal action against the listed account holders of mule accounts maintained with Axis Bank, ICICI Bank and UCO Bank, Baikunthpur Branch, whose accounts were used for cyber fraud, Police Station Baikunthpur registered Crime No. 218/2025 against the accused Anurag Sharma and 14 other account holders. After completion of the investigation, a charge-sheet has been filed for the offences punishable under Sections 111, 317(2), 317(4) and 317(5) of the Bharatiya Nyaya Sanhita (BNS). Hence, the bail applications.

4) Learned Advocates appearing for the applicants would submit that the applicants are innocent and have been falsely implicated in the crime in question. It is further submitted that the first bail applications of the co-accused persons have already been allowed by this Court vide order dated 28.07.2026 passed in MCRC No.6808/2026. It is contended that out of 14 witnesses, only four witnesses have been examined by the learned trial Court till date. They further submit that there are no criminal antecedents registered against the present applicants and they are in jail since 06.08.2025 and 07.08.2025, respectively. The charge-sheet has been filed and the conclusion of the trial is likely to take considerable time. Therefore, they pray for releasing the applicants on regular bail.

5) On the other hand, learned State Counsel opposes the bail application and submits that the charge-sheet has been filed in the present case. He further submits that the applicants were among the account holders whose bank accounts were allegedly used as mule accounts for facilitating cyber fraud transactions. It is alleged that the applicants,

along with other co-accused persons, were involved in permitting the use of their bank accounts for the transfer and routing of proceeds obtained through cyber fraud. Therefore, the applicants are not entitled to grant of bail.

6) I have heard learned counsel for the parties and perused the case diary.

7) From perusal of the case diary, it transpires that the applicants’ involvement was found in an organized cyber-financial fraud causing substantial monetary loss and public harm. Further, co-accused persons have already been enlarged on bail in MCRC No.6808 of 2026, and out of 14 witnesses, only 4 witnesses have been examined. The applicants have no criminal antecedents. Further, the chargesheet has been filed and the applicants are in jail since 06.08.2025 and 07.08.2025, respectively. Considering the aforesaid facts and circumstances of the case, I am inclined to grant bail to the applicants. Accordingly, the bail applications filed under Section 483 of the BNSS, 2023 are allowed .

8) It is directed that, in the event of the applicants executing a personal bond of Rs.50,000/- each, with one surety in the like sum to the satisfaction of the concerned Trial Court, they shall be released on bail on the following conditions:-

(i) they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such fact to the Court;

(ii) they shall not act in any manner which will be prejudicial to fair and expeditious trial, &

(iii) they shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial.

The observation made hereinabove is for the purpose of deciding this bail applications only, the learned trial Court shall decide the case

on its own merits.
