1. This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No.44/2025 registered at Police Station Kabir Nagar, Raipur (C.G) for the offences under Sections 103(1), 80 of B.N.S. 2023.

2. As per the prosecution case, the appellant was husband of deceased wife Smt. Suhani Singh @ Kanchan. On 04.04.2025, an information was received at P.S. Aamanaka about the death of deceased, on which, inquest proceedings was conducted and the statements of parents of deceased were recorded by the Executive

Magistrate. The parents of deceased stated that the deceased was subjected to cruelty for demand of dowry and on 03.04.2025 the deceased was assaulted by the applicant in kitchen, thereafter she was admitted to Hospital by the applicant and during the course of treatment she died on 04.04.2025 in hospital.

Learned counsel for the applicant submits that the present applicant has been falsely implicated and after marriage the deceased cohabited with the applicant for about 3 years, during which, she had never made any complaint about demand of dowry or cruelty. She further submits that there was no incriminating evidence to connect the applicant with the crime in question and the applicant was inculpated merely on the basis of his marital status with the deceased. She further submits that the applicant is in jail since 06.04.2025 and till date out of a total 33 witnesses, 15 have been examined and there is no immediate possibility of disposal of case, therefore, the applicant may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail application and submits that the Postmortem report as also the FSL report consistently support the prosecution case, which shows that the death was the result of strangulation.

5. Having considered the submissions made by learned counsel for the parties and the material available on record, I am not inclined to to release the applicant on regular bail. Accordingly, the bail application is rejected .
