1 ) The applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.210/2026, registered at Police Station Dipka, District – Korba (C.G.) for the offence punishable under Sections 64(1), 64(2)(E), 74, 115 & 351(3) of BNS 2023.

2 ) As per the case of the prosecution, the victim lodged a report against

the applicant alleging that she was working in the same company as the applicant and used to visit the applicant's house since 2015. On 1.1.2016, the applicant came to the house of the victim in the absence of her husband and had sexual relations with her. On 23.5.2026, the applicant met her and threatened her by stating that he had a naked video of the victim and thereafter again had sexual relations with her and also assaulted her. As the case has been shown to be sensitive, a copy of the FIR has not been filed along with this petition.

3 ) Learned counsel for the applicant would submit that the report was lodged by the victim after a lapse of 10 years. He would further submit that both the applicant and the victim are married and are residing with their respective families. He would submit that the applicant is in jail since 20.7.2026, the charge-sheet has been filed, and the trial is likely to take some time for its conclusion. Therefore, he prays for grant of regular bail to the present applicant.

4 ) On the other hand, learned State counsel opposes the bail application and submits that there is one criminal antecedent pending against the present applicant, registered under Sections 115(2), 296, 3(5) and 351(3) of the BNS. He would submit that the application deserves to be dismissed.

5 ) I have heard learned counsel for the parties and perused the case diary.

6 ) Having considered the fact that the present applicant and the victim aged about 35 years, were in a relationship from 1.1.2016 to 23.5.2026, that the charge-sheet has been filed, that the applicant is in

jail since 20.7.2026, and also considering the fact that there is one criminal antecedent against the applicant, I am inclined to grant regular bail to the present applicant.

7 ) Accordingly, the bail application filed by applicant is allowed and i t is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with one surety to the satisfaction of the concerned Trial Court, he shall be released on bail, on following conditions :-

(i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court,

(ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, and

¶31

(iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial,

(iv) he shall not involve himself in any offence of similar nature in future.

The observations made in the course of this order are only for considering the case of the applicant on the application for grant of regular bail. The concerned trial Court shall not be influenced or bound by the observations made in the course of this order.
