1) The applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, he has been arrested in connection with Crime No.279/2026 registered at Police Station, Dari, District Korba (C.G.) for the offence under Section 69 of the Bhartiya Nyaya Sanhita, 2023.

2) As per the prosecution story, in brief, is that an FIR was lodged on 16.07.2026 by the victim making an allegation that the present applicant, who is working on the post of Platoon Commandant and posted at Durg, on the pretext of marriage, sexually exploited her for a

period from 11.05.2025 to November, 2025. On such complaint, the police registered offences as stated above.

3) Ms. Kochar, learned counsel for the applicant would submit that there was some consensual relationship between the present applicant and the victim. She would further submit that the age of the victim was around 20 years in the year 2025 and they maintained a relationship for a period of 6 months. She would contend that the charge-sheet has already been filed and the applicant is in jail since 25.07.2026 and, thus, she would pray for grant of bail to the present applicant.

4) On the other hand, Mr. Dembra, learned counsel appearing for the complainant/victim would oppose the bail application. He would submit that there was an assurance given by the applicant to marry the complainant, but later on, that promise was broken. He would further contend that the present applicant is pressurizing the complainant to withdraw her complaint. He would submit that as there are direct allegations against the present applicant, who is working on the post of Platoon Commandant, the application deserves to be rejected.

5) Mr. Vivek Sharma, learned Panel Lawyer appearing for the State would support the contention made by Mr. Dembra.

6) I have heard learned counsel for the parties and perused the case diary.

7) Having considered the fact that the victim is an educated lady, aged about 20 years, and there was a consensual relationship between them which continued for a period of 6 months and subsequently, the applicant refused to marry the complainant and the FIR was lodged and the charge-sheet has been filed and the applicant is in jail since

25.07.2026, I am inclined to grant bail to the applicant. Accordingly, the bail application filed under Section 483 of the BNSS, 2023 is allowed .

It is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail on the following conditions:-

(i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court;

(ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, &

(iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
