Raigarh for the offence punishable under Section 7 of The Chhattisgarh Gambling (Prohibition) Act, 2022, 112(2) and 3(5) of BNS, 2023.

3. As per prosecution case, on 31.05.2026 Kharasia Police received a secret information that present applicants are engaged in online gambling. When the police party conducted raid at the suspected place i.e. Gun Bazar, they found both the applicants in front of the house of Gagan Agrawal. On being interrogated, they disclosed that they were engaged in playing online gambling along with other coaccused Rikesh Rai, Arjun Rathore and Sahil Agrawal. When the police conducted raid in the house of accused Sahil Agrawal, he fled away, however, from his house, cash amount of Rs.31,99,700/- and a currency counting machine was seized. From the mobile phone of Gagan Agrawal grandexch.com and from the mobile phone of Shubham Agrawal radheexch.com online gaming app was recovered. FIR was registered and they were arrested in which they are claiming regular bail.

Learned Counsel for the applicants would submit that except the memorandum statement of present applicants, there is no material in the case diary that the applicants are actively involved in playing online gambling along with other accused persons. They have no connection with Sahil Agrawal and it is only the police raised suspicion that along with Sahil Agrawal, the present applicants are also involved. There is no money transaction extracted from the mobile phone of present applicants. Only gaming App was found in their mobile phones. The applicants are respectable person of community and society. They

would also submit that against the applicant Shubham Agrawal only one criminal antecedent is there which was disposed of in the year, 2022, however, against the applicant Gagan Agrawal, though there are nine criminal antecedents, however, except two offences, the other cases have been disposed of. They are in jail since 01.06.2026, final adjudication of the case will take its own time, and therefore, they may be enlarged on bail.

On the other hand the counsel for the State opposes the bail applications and have submitted that it is the present applicants who disclosed the name of Sahil Agrawal on whose instance they are engaged in playing online gambling and when the police conducted raid in the house of Sahil Agrawal, he fled away and from his house huge cash amount of Rs.31,99,700/-and currency counting machine has been seized. The present applicants are key persons on whose instances the involvement of accused persons in online gambling has been disclosed. The applicant Shubham Agrawal is having one criminal antecedent of similar nature of offence in which he has been convicted and the applicant Gagan Agrawal is having nine criminal antecedents, though seven cases have been disposed of and two cases are pending, however, the registration of 9 offences itself disclose that he is an habitual offender of similar nature of offence. Investigation is still going on and charge sheet has not been filed. Therefore, looking to the gravity of the offence, their network for playing online gambling and their involvement with other co-accused persons, they are not entitled for bail.

6. I have heard the counsel for the parties and perused the material annexed with the bail applications as well as case diary.

Considering the submissions made by the counsel for the parties, considering the nature of allegations and the material collected during investigation, seizure of huge cash amount of Rs.31,99,700/- from the house of Sahil Agrawal on disclosure statement made by the present applicants, recovery of active gaming platform of grandexch.com and radheexch.com from the mobile phones of the applicants, criminal antecedent against the applicants of same nature and also considering the fact that further investigation is going on and charge sheet has not been filed, I am not inclined to release the applicants on bail at this stage.

8. Accordingly, the bail applications of both the applicants Gagan Agrawal and Shubham Agrawal are rejected.
