1. This is second bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita 2023 for grant of regular bail to applicant, who has been arrested in connection with Crime No.73/2025, registered at P.S.Sarkanda, District Bilaspur (C.G.) for commission of offence punishable under Sections 109 & 103 (1) of Bharatiya Nyaya Sanhita, 2023.

2. First bail application of the applicant was dismissed vide order dated 27.04.2026 passed by this Court for want of prosecution.

Case of prosecution, in brief, is that on 14.01.2025 at about 8:00 a.m., the complainant received a phone call from a boy named Pau informing him that his aunt had been assaulted and was lying unconscious outside her house. The complainant, along with his elder brother, immediately reached the spot and found the victim lying unconscious on the road with a grievous head injury allegedly caused by a stone/boulder. She was shifted to CIMS Hospital, Bilaspur for treatment. During inquiry at Sanjay Nagar, Chantidih, the present applicant/accused, Nand Kumar @ Chhoti, who was a frequent visitor to the victim's house, allegedly stated without being questioned that the victim must have been hit with a bolder, thereby arousing suspicion against him. On the basis of such suspicion and the subsequent investigation, the police arrested the present applicant and filed the charge-sheet against him.

4. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case. He further submits that the report against the applicant has been lodged on the basis of suspicion only. He further submits that there is no any direct evidence against the applicant. Applicant is in jail since 15.01.2025 and trial is likely to take some time, therefore, it is prayed that applicant may be enlarged on bail.

5. Learned State Counsel opposes the bail application filed by the applicant. He further submits that the applicant was the frequent visitor of the deceased house wherein the deceased was found lying in dead condition. He further submits that as per memorandum statement of the accused/applicant, one blood stain piece of stone was seized.

6. I have heard learned counsel appearing for the parties and perused the case diary.

7. Considering the facts and circumstances of the case, nature and gravity of the offence, and also material available on record, without commenting on merits of the case, I am not inclined to grant bail to the applicant.

8. Accordingly, the present bail application is rejected.
