The applicant has preferred this 2^nd bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act, 2023 for grant of regular bail as he is arrested in connection with crime No.54/2025, registered at Police Station – Champa, DistrictJanjgir-Champa (C.G.) for offence punishable under Sections 296, 351(3), 118(2), 190, 191 (2)(3), 111 (1), 109, 103(2) of B.N.S. and Sections 25 & 27 of Arms Act.

First bail of the applicant was dismissed on merit vide order of this Court dated 24.09.2025 passed in MCRC No.7633/2025.

In this case, there are total 10 accused persons out of which 3 are juvenile and 7 are major accused. The prosecution's case, in

short, is that on 16.02.2025, the accused/applicant along with other co-accused persons with a common intention, assaulted Ramdhan Patel and Sahil Patel with knife due to which Ramdhan Patel sustained grievous injuries and died. Based on above, offence has been registered against the applicant.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. He further submits that out of 10 accused persons including the applicant herein, 6 have already been granted benefit of bail. Further, out of 38 prosecution witnesses, 16 have been examined, and the memorandum witness has not supported the case of the prosecution. The counsel further submits that the applicant is in jail since 19.02.2025 and the trial is likely to take time to be finalized. Therefore, it is prayed that the applicant may be enlarged on bail.

Per contra, learned Counsel appearing on behalf of the State opposes the bail application, submitting that the post-mortem report of the deceased, Ramdhan, indicates assault by a sharp and pointed object and a knife has been seized from the applicant. Furthermore, the deceased's statement was recorded under Section 161 Cr.P.C. before his death, naming the applicant, therefore, looking to the nature of offence, the applicant may not be released on bail.

I have heard learned Counsel appearing for the parties and perused the material available on record.

Considering the facts and circumstances of the case, and overall evidence collected by the prosecution against the applicant and also considering the fact that there is no change of circumstances after rejecting of the first bail application, at this stage, without commenting on merits of the case, I am not inclined to release the applicant on bail. Accordingly, the bail application filed under Section 483 of BNSS, 2023, is rejected .

However, considering the fact that the applicant is in jail since 19.02.2025, and only 16 witnesses out of 38 witnesses have

been examined till date, the concerned trial Court is directed to expedite the trial and to ensure that the trial is concluded as expeditiously as possible preferably within a period 5 months from receipt of a copy of this order.

Office is directed to sent a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith.
