1. This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No.30/2025 registered at Police Station Mahila Thana Kawardha, District Kabirdham (CG) for the offences under Sections 74, 75(2), 331(Ga) of BNS and Section 8 of the POCSO Act.

The prosecution story, in brief, is that on 04.06.2025, the mother of victims lodged a report that on 04.06.2025 the complainant went for doing work and when she returned home , her elder daughter told her that the applicant came to their house at afternoon and when she was doing house hold work in the kitchen with her sister and friend, the applicant called the victim in other room and molested and abused her and when she started shouting the applicant ran away. At the same time, her younger daughter also told that the present applicant had done same act with her near a tube-well room. On such report, the the applicant was arrested.

Learned counsel for the applicant submits that the statements of the minor victims and their mother have been recorded and there was a family dispute between the complainant and the father of applicant and due to grudge against his father, the applicant has been roped in crime. He further submits that looking to the charge sheet, no such accusations are available to attract the ingredients of crime in question and only general bald allegations have been made against him. He submits that the applicant is in jail since 06.06.2025 and there are total 15 witnesses yet to be examined in this case and further there is remote possibility of early conclusion of case, therefore, the applicant may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail application and submits that the applicant has tried to outrage the modesty of two minor girls who are sisters and one of them is handicapped.

5. The victims along with her mother have appeared through VC from the concerned DLSA and their mother raised objection to grant bail.

6. Having considered the submissions made by learned counsel for the parties and the material available on record and further looking to the custody period of the applicant and the trial is likely to take further time, I am inclined to release the applicant on regular bail at this stage.

7. Accordingly, this bail application is allowed and the applicant is directed to be released on bail on his furnishing a bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court for his appearance before the said Court as and when directed in that behalf.
