By way of the instant MCC, the applicant/Insurance Company seeks modification in the judgment dated 10.12.2025, passed in MAC No. 882 of 2024 by this Court.

Mr. Pravin Kumar Tulsyan, leaned counsel appearing for the applicant would submit that an award was passed by the learned Claims Tribunal on 04.03.2024 with stipulation of pay and recover, but such stipulation does not find place in the judgment passed by this Court in MAC No. 882 of 2024 dated 10.12.2025. He would submit that in conclusion paragraph same may be mentioned.

On the other hand, Mr. A.D. Kuldeep and Ms. Seema Verma, learned counsels appearing for the respective non-applicants would oppose.

Taking into consideration the fact that the learned Claims Tribunal directed the Insurance Company to satisfy the award first and recover it from the driver and owner of the offending vehicle and such observation is not mentioned in the judgment passed in MAC No. 882 of 2024 dated 10.12.2025. Therefore, the application (MCC) moved by the Insurance Company is hereby allowed . The Insurance Company shall satisfy the compensation pursuant to award passed by the learned Claims Tribunal and recover it from the driver and owner of the offending vehicle. Such stipulation shall be part of the judgment passed in MAC No. 882 of 2024 dated 10.12.2025.

With the aforesaid modification, the instant MCC is disposed of .
