3rd September, 2026. During course of mediation, both the parties have arrived at settlement which is recorded by the mediator forming part of the record and therefore, this appeal may be disposed of in accordance with the terms of the settlement arrived between the parties in mediation proceedings.
“a. That, at present both the children are with party No. 1. b. That, the parties have amicably settled that the parties shall bear the custody of both children periodically and the children shall not be separated from each other anytime without their consent.
c. That, Party No. 2 shall keep custody of children on every Saturday, Sunday, holidays including festivals and on rest of the days the custody of children shall remain with the father with visiting rights of mother.
d. That, the children shall reside in the place/house of the party which is nearest to their school so that studies can continue without any hindrance.
e. That, both the parties shall not pressurize children against their will for residing with them and strictly not abuse the liberty by ill-treating them.
f. That, both the parties shall have the visiting rights to visit their children at the time when the other party has the custody of the child as per above mentioned terms.
g. That, in case if a child falls sick, then the parties shall immediately inform each other and further, the custody shall be preferred to the mother with a preferring visitation right to the father or vice versa with consent of both the parties.

h. That, the Parties agree to maintain cordial and respectful relations with each other and shall endeavor to maintain family harmony so that there is no adverse mental effect over the children.
i. That, both the parties shall be responsible for due care, education, health and better future of children.
j. That, both the parties shall have right to visit and meet each other at reasonable times and occasions, and the parties shall cooperate in maintaining family bond and relationship.
k. That, the parties are willing to close the litigation F.A. (MAT) 31 of 2024 pending before the Hon'ble High Court of Chhattisgarh and Case No. 51/2023, pending before learned 1" Additional Principal Judge, Family Court, Raipur (C.G.).
l. That, the parties shall be at liberty to revise the aforesaid terms and conditions with mutual consent as and when the situation arises.”
