This petition has been preferred by the petitioner under Section 528 of BNSS, 2023 being aggrieved by the impugned order dated 02.12.2025 passed by the learned Special Judge Mines and Minerals (Development and Regulation) Act, 1957, Bilaspur, District – Bilaspur (C.G.) in

Special Case (Mines and Minerals ) No. 27/2025 whereby the learned special judge has rejected the application under Section 497 of BNSS for releasing the vehicle on supurdnama.

Learned counsel for the petitioner submits that he does not want to press this petition and wants to withdraw the same with liberty to file an appropriate application before the appropriate Bench. He prays to return the certified copy of the impugned order.

Learned State counsel pointed out that on 02.01.2026, CRR No. 1539/2025 was also dismissed as withdrawn by the counsel with liberty to file the appeal as provided under the Mines and Minerals (Development and Regulation) Act, 1957, but the counsel has filed this CRMP instead of an appeal.

Prayer is allowed.

Accordingly, the petition is dismissed as withdrawn with the aforesaid liberty. The Registry is directed to return the certified copy of the impugned order to the counsel for the petitioner, after retaining a photocopy of the same.
