Heard Mr.Virendra Verma, learned counsel for the petitioner as well as Mr.Priyank Rathi, learned Government Advocate appearing for respondent No.1/State.

The petitioner has filed this petition under Section 528 BNSS with following prayer:-

“i. That, the Hon'ble Court may kindly be pleased to allow the instant petition under section 528 of B.N.S.S. 2023 filed by the petitioner.

ii. The Hon'ble Court may kindly be pleased to quash the F.I.R. bearing no. 245/2019 registered as police station Tarbahar Bilaspur for the offence under section 420, 34 of I.P.C.

iii. That, the Hon'ble Court may kindly pleased to quash the entire charge sheet filed on dated 02.09.2020 before learned Judicial Magistrate First Class Bilaspur.”

Learned counsel for the petitioner submits that the case pertains to the year 2019, and the charge-sheet was filed against the petitioner on 02.09.2020. It is further stated that the petitioner has been granted bail by the competent court, and till date, no charges have been framed against him. He has drawn the attention of this Court to the order dated 17.01.2022, wherein the learned Magistrate observed that the case does not fall within the category laid down by the Apex Court for disposal within a stipulated time. It is further submitted that charges could not be framed due to the absconding of the co-accused, as reflected in the order sheet dated 03.02.2026. He also submits that another case has been registered against the petitioner, in which he has likewise been granted bail. In view of the same, he prays that the

proceedings be quashed.

On the other hand, learned Government Advocate appearing for respondent No. 1/State opposes the submissions made by the learned counsel for the petitioner.

Considering that the trial of the petitioner has been pending since 2019, the trial Court is directed to separate the trial of the present petitioner, proceed in accordance with law, and conclude the same expeditiously.
