Five petitioners (Jay Katiyar and family members) filed a petition under Section 528 BNSS seeking quashing of FIR No. 15/2026 dated 05.02.2026 registered at P.S. Mahila Thana, District Raipur, for alleged offences under Sections 85 and 3(5) of the Bharatiya Nyaya Sanhita, 2023, and stay of their arrest. Learned counsel for the petitioners submitted that the mediation had been successful and the matter was compromised before the Mediation Center of the Court on 17.03.2026, petitioner No. 1 (Jay Katiyar) and respondent No. 2 (Smt. Poonam Katiyar) being ready and willing to live together; the Government Advocate for respondent No. 1/State did not dispute this. The Court found the compromise dated 17.03.2026 to show an amicable settlement subject to fulfillment of its terms and conditions, and accordingly quashed the FIR, conditioning the quashing on fulfillment of the terms and conditions of the compromise. Heard Mr.Ashish Gangwani, learned counsel for the petitioners as well as Mr.S.S.Baghel, learned Government Advocate appearing for respondent No.1/State.

The petitioners have filed this petition under Section 528 BNSS with following prayer:-

“A. Quash the impugned First Information Report dated 05.02.2026, bearing no. 15/2026, registered at P.S.-Mahila Thana, District- Raipur, Chhattisgarh, for the alleged offences under Sections 85 and 3(5) of Bhartiya Nyaya Sanhita, 2023, being false, malicious, and an abuse of process of law;

B. Stay the arrest of the Petitioners in connection with FIR No. 15/2026 dated 05.02.2026 registered at Police Station Mahila Thana, District Raipur, under Sections 85 and 3(5) of Bhartiya Nyaya Sanhita, 2023, during the pendency of the present petition;

C. Any other relief which this Hon'ble Court deems fit and proper may also kindly be granted to the Petitioners, in the interest of justice. An affidavit in support of is filed herewith.”

Learned counsel for the petitioners submits that the mediation has been successful, and the matter has been compromised between the parties before the Mediation Center of this Court on 17.03.2026. Petitioner No. 1 and Respondent No. 2 are ready and willing to live together.

Learned Government Advocate appearing for Respondent No. 1/State does not dispute the said fact.

A perusal of the compromise dated 17.03.2026 shows that the matter has been amicably settled between the parties, subject to the fulfillment of the terms and conditions mentioned therein.

As the matter has already been compromised between the parties before the Mediation Center of this Court on 17.03.2026, and Petitioner No. 1 and Respondent No. 2 are ready and willing to live together, we hereby quash the FIR bearing Crime No. 15/2026 dated 5.2.2026, registered at Police Station Mahila Thana, Raipur, District Raipur, for offences under Sections 85 and 3(5) of the Bharatiya Nyaya Sanhita, 2023, subject to the fulfillment of the terms and conditions of the compromise arrived at between the parties
